Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the platform, products, services, and tools provided by Family Party Favors LLC ("Company," "we," "us," or "our"). This Policy applies to all users, including individual merchants, business entities, employees, contractors, and any other persons who access or use our platform. By accessing or using any of our Services, you agree to comply with this Policy.
1. Scope of Services
Family Party Favors LLC provides a SaaS platform that enables businesses to operate customizable ecommerce storefronts. Our Services include: customizable ecommerce storefront creation and management, product catalog and listing management, order processing and management, AI-powered product photography tools (the "Shots Tool"), AI-powered customer service chatbot functionality, analytics and reporting tools, and any additional features made available through the platform.
2. Permitted Uses
You may use our Services solely for lawful business purposes, including: creating and managing a legitimate ecommerce storefront, uploading and managing product listings, processing and fulfilling customer orders, using the Shots Tool to generate product photography for products you are legally authorized to sell, using the AI chatbot for customer service, customizing your storefront appearance and branding, and integrating with officially supported third-party tools.
3. Prohibited Uses
3.1 Illegal Activities — Engaging in any activity that violates applicable law, selling illegal products, facilitating fraud, selling counterfeit goods, operating fraudulent business models, or engaging in deceptive trade practices.
3.2 Prohibited Products and Services — You may not sell: illegal drugs, firearms, tobacco products, alcohol (without proper licensing and written approval), unapproved pharmaceuticals, pornographic material, products promoting violence or hatred, endangered wildlife products, stolen property, recalled products, or gambling services (without licensing).
3.3 Harmful or Abusive Conduct — Harassing, threatening, impersonating, discriminating, stalking, inciting violence, or exploiting minors.
3.4 Spam and Unsolicited Communications — Sending spam, chain letters, harvesting contact information, or creating misleading email headers.
3.5 Security Violations and Technical Abuse — Unauthorized access attempts, denial-of-service attacks, introducing malware, reverse engineering, unauthorized scraping, circumventing security features, or overloading infrastructure.
3.6 Intellectual Property Violations — Infringing copyrights, trademarks, patents, or trade secrets. Uploading content you don't have rights to. Removing proprietary notices.
3.7 Resale and Unauthorized Use — Sublicensing or reselling the Services without written authorization, building competing products, sharing account credentials with unauthorized individuals.
4. Content Standards
All content you upload must be truthful, accurate, and not misleading. Product images must accurately represent products. Pricing must be clear. You must not upload unlawful, obscene, hateful, harassing, fraudulent, or infringing content. Content should be professional in tone.
5. AI Tools Usage Policy
5.1 Shots Tool — Use only for generating legitimate product images. Images must accurately represent products. Do not create misleading, infringing, violent, obscene, or harmful images. Disclose AI-generated images when required by law.
5.2 AI Chatbot — Do not configure to provide false information. Do not use to collect sensitive personal information without consent. Do not override safety filters. You are responsible for monitoring chatbot interactions.
5.3 General AI Rules — AI content may not always be accurate. You are responsible for reviewing all AI-generated content before publishing. Do not reverse engineer AI models.
6. Account Responsibilities
Maintain account security and credential confidentiality. Provide accurate information. If you permit others to use your account, you are responsible for their compliance. Ensure compliance with all applicable laws and regulations.
7. Monitoring and Enforcement
We reserve the right to monitor your use of the Services. Enforcement follows a graduated approach:
First Violation: Written warning with 5 business days to correct.
Second Violation: Temporary suspension of affected features.
Third Violation: Full account suspension up to 30 days.
Severe Violations: Permanent termination without warning.
We may bypass the graduated process for severe violations. You may appeal enforcement actions by emailing customerservice@familypartyfavors.com within 10 business days.
8. Reporting Violations
Report violations to: customerservice@familypartyfavors.com, (+1) 786-263-1535, or by mail to 1545 NW 15th Street Rd, 101, Miami, FL 33125. Include as much detail as possible. We prohibit retaliation against good-faith reporters.
9. Indemnification and Liability
You agree to indemnify Family Party Favors LLC from claims arising from your violation of this Policy or your User Content.
10. Modifications
We may modify this Policy at any time. For material changes, we will provide at least 30 days' notice. Continued use constitutes acceptance.
11. Severability
If any provision is found invalid, the remaining provisions continue in full force.
12. Governing Law
Governed by the laws of the State of Florida. Disputes in Miami-Dade County courts.
